Data Protection and Privacy
If you need to submit information considered 'personal data' or 'sensitive personal data' under GDPR, this should be submitted in a separate document. This document should not cross-reference others, so that it can be marked as confidential. The definition of 'personal data' and 'sensitive personal data' can be found on page 8 of Information Commissioner's Office (ICO) GDPR. It will include, for example, personal circumstances or health information.
All applications and supporting documentation will be published on the website. Private telephone numbers, private email addresses and signatures will be removed prior to publication. We are committed to ensuring that your privacy is protected by adhering to the EU General Data Protection Regulation (GDPR). Any personal information provided will be used by us solely for the purpose of processing your application and contacting you regarding this. The data will be processed in accordance with our full privacy policy.

Equality and Diversity
Our Diversity Policy promotes inclusion for all sectors of the community. Applications/supporting information, along with any representations received from the public, will be checked for any inappropriate comments. Only planning related matters can be considered. Any comments regarding protected characteristics (listed below) or that are defamatory, prejudiced or otherwise likely to cause offence to the subject of the comments or any other reader will be removed. Any comments that are considered to constitute hate incidents or hate crimes may be passed to the police.
The protected characteristics under the terms of the Equality Act 2010 are:
- age
- disability
- gender reassignment.
- pregnancy and maternity
- race
- religion or belief
- sex

Accessibility
The Council is committed to ensuring that its website and documents published there are accessible to people using assistive technologies.
However, as Planning Applications are submitted to the Council via third parties (applicants and agents) it is not always possible to publish these documents in an accessible format. This is permitted under the Public Sector Bodies (Websites and Mobile Applications) (No. 2) Accessibility Regulations 2018. Documents published by South Hams and West Devon Councils from 2019 onwards should be available in accessible formats.
